1. Acceptance of Terms
By using the MotoPlanner.com website and the MotoPlanner mobile applications for iOS and Android (collectively, the "Services"), you agree to these Terms and Conditions. If you do not agree, please do not use the Services. We may modify these Terms at any time: changes will be published on the Services, and continued use after publication constitutes acceptance.
2. Services Provided
MotoPlanner provides, through the website and the iOS and Android apps, tools to plan motorcycle itineraries. In particular you can:
- Create routes and download them as GPX files, for use on any compatible device or navigator.
- Save routes to the cloud, import GPX tracks, and organize them in folders (some features require the PLUS Subscription).
- View points of interest (passes, scenic roads, picnic areas) and contribute reports, photos, and comments.
- Open route segments in third-party navigation apps (e.g., Google Maps).
- Follow routes and tracks with the built-in navigation, designed as a helper/back-up (also offline) to your preferred navigator.
Basic use is free. The PLUS Subscription unlocks advanced features, described on the Services at the time of purchase.
3. Accounts and Registration
- Registration is free and not required for basic use; it is needed to save content to the cloud, contribute, or subscribe to PLUS.
- You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account.
- The Services are not intended for users under 16.
- You can delete your account and associated personal data at any time, from the app or by contacting us (see the Privacy Policy).
4. PLUS Subscription, Payments and Renewals
- On the website the PLUS Subscription is purchased via PayPal.
- In the apps, purchases are made through the Apple App Store or Google Play and are managed by the respective store (in-app subscription management uses RevenueCat).
- In-app subscriptions renew automatically at the end of each period unless canceled at least 24 hours before expiry. Renewal is charged to your store account.
- You can manage or cancel the subscription at any time in your App Store or Google Play account settings; cancellation stops future renewals but does not entitle you to a refund of the current period, except as provided by store policies or applicable law.
- Refunds for in-app purchases are subject to Apple and Google policies; PayPal purchases are non-refundable, except for exceptional cases evaluated individually or mandatory consumer rights.
- Subscription prices and benefits may change; changes will be communicated in advance and do not affect the period already paid.
5. Mobile Apps and Stores
- The apps are distributed through the Apple App Store and Google Play, and their use is also subject to the respective store's terms.
- These Terms are an agreement between you and MotoPlanner, not with Apple or Google. Apple and Google are not responsible for the app or its support.
- Support, maintenance, and any handling of claims about the app are MotoPlanner's responsibility, except for the store's obligations.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, by accepting, you acknowledge Apple's right to enforce them against you.
- You agree to use the app in compliance with the relevant store's usage rules and applicable laws (including export and sanctions laws).
6. Acceptable Use
You agree to use the Services lawfully and not to:
- Violate laws or third-party rights, or upload unlawful, offensive, or misleading content.
- Attempt unauthorized access, overload, mass-copy (scraping), or compromise the Services.
- Use the Services in a way that endangers your or others' safety while riding.
7. User Contributions
You may report roads, upload photos, and comment on points of interest. By uploading content, you confirm you hold the necessary rights and grant MotoPlanner a non-exclusive, royalty-free, worldwide, transferable license to host, display, distribute, and adapt that content within the Services and their promotion. Your content remains yours.
We may remove or moderate inappropriate content or content not compliant with the Terms. Published content may remain visible in anonymized form even after account closure.
8. Intellectual Property
The Services, the software, the "MotoPlanner" trademark, the graphics, and their content are protected by the intellectual property rights of MotoPlanner or its licensors. Map and routing data belong to their respective providers (e.g., Mapbox, OpenStreetMap, Thunderforest). You acquire no rights in the Services beyond the use permitted by these Terms.
9. Third-Party Services
The Services rely on third-party providers, including Mapbox and Thunderforest (maps and routing), the Apple App Store and Google Play (distribution and purchases), RevenueCat (in-app subscription management), PayPal (website payments), and DeepL (translations). Use of such services is also subject to their respective terms and privacy policies. MotoPlanner is not responsible for malfunctions or changes in third-party services.
10. Routes and Tracks Navigation
The built-in navigation follows the track on the map and is designed as a helper and back-up (also offline) to the navigator you normally use. It is a BETA feature: it is NOT a turn-by-turn navigator and does not provide voice guidance. In particular:
- It plays back the track but does not guarantee complete turn instructions for every maneuver; instructions may be missing, imprecise, or delayed (especially for GPX tracks).
- It does not consider in real time traffic, accidents, closures, one-way streets, prohibitions, speed limits, weather, surface conditions, or vehicle restrictions.
- Information about speed cameras and points of interest is indicative, may be incomplete or out of date, and does not replace road signs.
- Routes and tracks are not verified or guaranteed for feasibility, legality, safety, or suitability for your vehicle; GPS accuracy depends on the device.
You are solely responsible for your riding and for complying with traffic laws. Do not interact with the device while riding: stop safely to consult it. Always use caution and your own direct judgment. To the maximum extent permitted by law, MotoPlanner disclaims all liability for damages, violations, injuries, or losses, direct or indirect, arising from the use of the navigation, routes, or tracks.
11. Warranties and Limitation of Liability
The Services are provided "as is" and "as available", without warranties of accuracy, continuity, or absence of errors. You acknowledge that:
- The information provided (routes, POIs, times, distances, speed cameras) may not be up to date or accurate.
- Use of the Services is at your own risk and always requires caution and compliance with the law.
- To the maximum extent permitted by law, MotoPlanner is not liable for direct, indirect, incidental, or consequential damages arising from the use of, or inability to use, the Services.
- Nothing in these Terms excludes or limits liability that cannot be excluded by law, including mandatory consumer rights.
12. Suspension and Termination
You may stop using the Services at any time and delete your account. We may suspend or terminate access in case of breach of the Terms, unlawful or abusive use, or for technical/legal reasons. Upon termination, the clauses on contributions, intellectual property, and liability survive to the extent applicable.
13. Changes to the Terms
We may update these Terms at any time. Material changes will be signaled through the Services and, where appropriate, in the app. Continued use after the update implies acceptance of the revised Terms.
14. Governing Law
These Terms are governed by Italian law. The mandatory consumer protections of your country of residence within the European Union remain unaffected. Disputes are subject to the court designated by the law applicable to the consumer.
